1. Definitions

In these Terms and Conditions:

The term RememberLife Limited or RememberLife or Remember Life or rememberlife.co.uk are interchangeable and shall mean RememberLife Limited.

2. Terms of Use

2.1 By using, accessing, browsing or submitting any material to this Site you agree to these Terms and Conditions without limitation or qualification. If you do not agree to these Terms and Conditions then you may not use this site and please exit now.

4. Duration and Termination

4.1 Each time you make payment for an entry you wish to submit on this Website it will be classified as a separate contract with us.

4.2 Each contract will run for a period of two years from the later of cleared funds being received or the entry posted.

4.3 You may cancel your contract with us at any time by e-mailing us at info@rememberlife.co.uk

4.4 You will be alerted by e-mail 7 days before the expiry of your contract with us and given an opportunity to renew that contract on payment of a further price specified at that time on our Website.

4.5 We may terminate this contract and delete any entry you have made either in the event of you breaching the terms of this agreement or if, in our sole discretion, any entry you post is vulgar, profane, abusive, hateful, defamatory, threatening, disparaging, false, misleading, deceptive, fraudulent, inaccurate, or for any other reason whatsoever and we shall not be held responsible in the event of any termination to return all or part of any money you have paid to us.

5. Warranty, Indemnity and Acknowledgement

5.1 You agree to indemnify and hold RememberLife Limited its subsidiaries, agents, officers, directors, shareholders and employees harmless from any claim or demand, including legal fees made by anyone in relation to any material you submit, post, transmit, display, publish or distribute on or through this Site, your use of this Site, or any breach of these terms.

5.2 You warrant that:
(i) You will at all times comply with these Terms and Conditions
(ii) You will indemnify us in connection with any costs, proceedings, claims or actions arising from any breach by you of the terms of this agreement
(iii) Those in respect of whom you are writing the obituary are deceased and that you have, where applicable, the next of kin's permission to do so
(iv) You will not use any information posted on this Site for your own or others' financial or business gain
(v) You have the legal right to post any material which you do post on this Site
(vi) You are the author of any material you post or that it is not protected by copyright or if it is you have express permission from the copyright owner to post such material.
(vii) You will not post vulgar, profane, abusive or hateful language, epitaphs or slurs, illustrations, defamatory remarks or comments of a racial or religious nature so as to intend to cause religious or racial hatred and that no material you post will be threatening, disparaging, inflammatory, false, misleading, deceptive, fraudulent, inaccurate, contains any actionable statement and does not violate the privacy rights of any third party. reproducing any entries you have created providing it is not for commercial gain.

5.3 You acknowledge that all content of this Website is copyright of RememberLife.co.uk and RememberLife Limited and/or its business partners. You will not use all or part of this website or its contents without our express consent. For the avoidance of doubt nothing in this provision will prevent you from reproducing any entries you have created providing it is not for commercial gain.

7.1 This website is hosted by a third party with whom we have a separate contract.

7.2 While we will endeavour to ensure that this Website remains open, functional and accessible at all times we will not be liable if for any reason this Website becomes unavailable for any period whatsoever resulting from any action or inaction by our host provider.

8. Guest Book and Memorials

8.1 On payment of the price referred to elsewhere in this Website you will be entitled to open a guest book. You acknowledge that members of the public may access the guest book and post comments upon it and you further acknowledge that neither RememberLife.co.uk nor any of its business partners, directors or shareholders will be responsible for any information published on that guest book. An e-mail will be sent to you notifying you that an entry has been made upon the guest book and you may, at your discretion, edit or delete any of the entries made. RememberLife.co.uk will have the ultimate decision as to whether or not to allow an entry in a guest book or the publishing of a memorial which decision shall be final and shall be in its sole discretion. In the event any entry on the guest book or memorial is deleted or modified by Us then any money you have paid will be non-refundable unless at the sole discretion of RememberLife Limited.

9. Privacy Statement

9.1 Your privacy is important to us so we only use the information you provide about yourself when using this Website to answer your enquiry or to assist us to improve our service to you. We do not share this information with any third party except to the extent necessary to answer your query, if that enquiry requires the involvement of a third party. We use return email addresses to answer any emails we receive. Such addresses are not used for any other purpose and are not shared with outside parties.

We believe strongly in protecting our customer’s privacy so when we collect personal information from you, or when you use our Website we will use our best endeavours only to use it or disclose it in the manner stated below. By using our Website services you agree that we may do so.
